What is a redundancy situation?

A redundancy situation will most commonly arise if your employer closes its business, a workplace within its business or if it no longer needs as many employees to undertake a particular type of work.

What is my statutory redundancy entitlement?

If you have two or more years’ continuous employment by the time your employment ends because of a redundancy situation, you will be entitled to a statutory redundancy payment.

Statutory redundancy pay is calculated according to a formula based on age, length of service and pay. Firstly, you calculate your length of service. Then, counting backwards from the date that your employment ended, you would be entitled to:

  • One and a half weeks’ pay for each complete year of service after age 41;
  • One week’s pay for each complete year of service between ages 22 and 40; and
  • Half a week’s pay for each year of service under the age of 22.

A maximum of 20 years can be taken into account when calculating a statutory redundancy payment. Your gross week’s pay at the relevant date is capped at the statutory maximum, which is increased in February each year.

In addition, you should also receive a payment in respect of your notice period (if you are not being asked to work your notice) and a payment for any holiday entitlement that has accrued to you which you have not managed to take.

Your employer should also give you reasonable amounts of time off work, if you have job interviews to attend during your notice period.
