Personal Injury Trust

Personal Injury Trust

If you have been awarded compensation for a personal injury you may find that the award affects your means tested state benefits.

Your personal injury award has been made to cover your loss of earnings or maybe to pay for adaptations to your home. A personal injury trust may help you to be able to continue receiving state benefits by ensuring your compensation is not taken into account when deciding if you are entitled to benefits.

You and your partner can have £6,000 between you before your benefits will be affected. The trust operates by placing the money in an account or investment in the name of Trustees (often you and your spouse or partner, parents, friends or Solicitors). The Trustees hold the money for you as the beneficiary and release it as and when required. The trust money is in a special account separate from your personal finances.

We can help you with:

  • whether a Personal Injury Trust is right for you
  • who to appoint as Trustees
  • the preparation of suitable trust documents
  • tax returns for your trust
  • advice on how to run your trust and how to notify the Benefits Agency

Gotelee’s breadth of experience enables us to deal with all aspects of your personal injury from claim and settlement to the setting up of the trust with clear, concise advice every step of the way.
