A contract can be spoken or in writing and is essentially a deal – a legally binding promise. It is formed where there is an offer, acceptance, consideration (ie the sum of money agreed), and an intention to create legal relations.
If a contract is breached you should act swiftly to enforce it. The main remedy for breach of contract is damages, which are intended to put you in the position you would have been in had the contract not been broken. You may also want the other party to honour the contract or you may want to treat the contract as terminated.
